When asked about the importance of these satire shows and the messages they send, often writers and producers of this media scoff at a notion of their own significance or impact, arguing that their shows are purely entertainment. In Who Brings the Funny? ● 35 what may be my favorite interview moment of this project, I told comedian Lewis Black that academics found satire shows to affect political behavior, especially breeding cynicism. Black responded: Well, first tell those academics to fuck themselves .

The risk, I think, is how people misinterpret it, but it is such a brave way to add something satirically” (Stack 2010). Using this strict definition, the only exclusively satirical media today is The Colbert Report , where Stephen Colbert has created a faux-persona in “Stephen Colbert,” a pitch-perfect imitation of conservative punditry a la Bill O’Reilly. Colbert uses this character to argue (loudly and wrongly) the exact opposite of the point he is really making in order to show the faulty logic of his character’s point of view.

Satire fails this “actual malice” test, according to legal scholar Leslie Treiger: Because satire works through distortion of the familiar—while at the same time pretending to depict reality—in order to level criticism, it fails to gain protection under any of the three prongs of this standard. First, because it works through distortion, satiric material easily can be identified as falsity or, at best, exaggeration. Moreover, by definition satire often, on its face, has the appearance of fact. Second, satirical material is critical of its subject’s character or actions, and hence may be defamatory.
